4. Legal Services — Scope and Engagement

We provide legal services in the areas of estate planning, probate administration, and representation in contested inheritance matters. Services are provided under the laws of Thailand. We do not advise on matters falling outside Thai jurisdiction unless otherwise agreed in writing.

Each engagement is governed by a written engagement letter that sets out the scope, fees, and specific terms applicable to that instruction. In the event of any conflict between these general terms and an engagement letter, the engagement letter shall take precedence.

5. Fees and Payment

Service fees are stated in Thai Baht (THB) and confirmed in writing prior to commencement of work. Disbursements (such as court filing costs) are identified separately and agreed before they are incurred.

Payment terms are set out in the engagement letter. Unless otherwise agreed, fees are payable within 14 days of invoice. We reserve the right to suspend work on a matter where invoices remain outstanding.

We do not accept liability for exchange rate fluctuations affecting payments made in currencies other than THB.

6. Confidentiality

All information shared with us in the course of an engagement is treated as confidential and subject to professional privilege. We will not disclose client information to third parties without consent, except where required by law or professional obligation.

7. Intellectual Property

All content on this website — including text, design, and structure — is the property of Munkhong Legal and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any part of this website without our prior written consent, except as permitted by law.

Documents prepared for you in the course of an engagement remain our intellectual property until all fees have been paid in full, at which point ownership transfers to you.

To the fullest extent permitted by Thai law, our liability to you in connection with any matter shall not exceed the fees paid to us in respect of that specific engagement. We exclude liability for indirect or consequential losses, including loss of profit or opportunity.

Nothing in these terms limits our liability for fraud, death or personal injury caused by our negligence, or any other matter that cannot legally be excluded.

10. Indemnification

You agree to indemnify and hold harmless Munkhong Legal and its practitioners from any claims, costs, or damages arising from your use of this website in breach of these terms, or from inaccurate or incomplete information you have provided to us.

11. Termination

Either party may terminate an engagement by giving reasonable written notice. On termination, you are liable for fees and disbursements incurred up to the date of termination. We reserve the right to retain documents until all outstanding fees have been settled.

We may terminate an engagement immediately where continued representation would involve a conflict of interest, a breach of professional obligation, or where required by law.

12. Dispute Resolution

These terms are governed by the laws of Thailand. Any dispute arising from your use of this website or our services shall be subject to the exclusive jurisdiction of the Thai courts.
